That happened at a Regional when I was there. The judges said you couldn't but I think you should be able to just remove the card instead. No official ansewer though.

You cannot declare an attack while both are on the field, because you cannot meet the cost for Servant.

But is not a cost, cause you send it when you concluse the attack
